1. Introduction

These Terms & Conditions ("Terms") govern your use of CallZI and the text messages we send. CallZI ("CallZI", "we", "us", or "our") is operated by Rakesh M., located in Santa Clara, CA, and provides an AI phone receptionist for local service businesses.

By using CallZI, booking an appointment through a CallZI-powered business, or receiving our text messages, you agree to these Terms. If you do not agree, please do not use the service.

2. Messaging / SMS Terms

Your agreement to receive texts

By providing your phone number or consenting during a phone call with a business that uses CallZI, you agree to receive transactional appointment text messages from CallZI. Consent is obtained verbally during the call, where CallZI's AI states that a confirmation text will be sent to your number.

Types of messages we send

CallZI sends transactional messages only — specifically appointment confirmations and cancellations. A typical message asks you to "Reply YES to confirm or NO to cancel." We do not send marketing or promotional texts.

Message frequency and rates

Message frequency varies but is typically 1–2 messages per appointment. Message and data rates may apply, depending on your mobile carrier and plan.

How to opt out and get help

You can opt out at any time by replying STOP to any message; you will receive a single confirmation and we will stop sending you appointment texts. For help, reply HELP or contact vegancodesofficial@gmail.com. Opting out stops appointment texts but does not cancel any existing appointments — to change or cancel an appointment, contact the business directly.

Carrier disclaimer

Carriers are not liable for delayed or undelivered messages. Message delivery depends on factors outside our control, including carrier networks and device availability, and we cannot guarantee that every message will be delivered or delivered on time.

3. The Service

CallZI answers calls on behalf of participating local service businesses and helps customers book appointments. When an appointment is booked during a call, CallZI sends a confirmation text to the customer. Features and functionality may change over time as we improve the service.

4. Accounts (For Businesses)

If you create a business account to use CallZI, you are responsible for:

  • Providing accurate and complete account information.
  • Maintaining the confidentiality of your login credentials.
  • All activity that occurs under your account.

You must notify us promptly of any unauthorized use of your account. We may suspend or terminate accounts that violate these Terms.

5. Acceptable Use

You agree not to:

  • Use CallZI for any unlawful, fraudulent, or harmful purpose.
  • Use the service to send unsolicited, marketing, or spam messages.
  • Interfere with, disrupt, or attempt to gain unauthorized access to the service or its systems.
  • Misuse, reverse engineer, or copy the service except as permitted by law.
  • Violate the rights of others or any applicable law, regulation, or carrier or messaging requirement.

Businesses that use CallZI are responsible for ensuring they have a lawful basis to contact their customers and for complying with all applicable messaging laws and regulations.

6. Payment and Billing

Paid CallZI plans are billed through our payment processor, Stripe. By subscribing to a paid plan, you authorize us and Stripe to charge your designated payment method for the applicable fees.

  • Fees, billing cycles, and plan details are presented at the time of purchase.
  • Unless stated otherwise, subscriptions renew automatically until cancelled.
  • Except where required by law, fees are non-refundable.
  • We may change our fees with reasonable advance notice; changes apply to future billing cycles.

You are responsible for keeping your payment information accurate and current.

7. Third-Party Services

CallZI relies on third-party providers to operate, including sent.dm (SMS delivery), Firebase/Firestore (data storage), Google Calendar (scheduling), and Stripe (billing). Your use of the service may be subject to those providers' terms, and we are not responsible for the acts or omissions of third parties.

8. Disclaimers

The service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or secure, or that messages will always be delivered. As noted above, carriers are not liable for delayed or undelivered messages.

9. Limitation of Liability

To the maximum extent permitted by law, CallZI and Rakesh M. will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising from or related to your use of (or inability to use) the service or any messages sent or not sent. To the maximum extent permitted by law, our total liability for any claim relating to the service will not exceed the amount you paid to us for the service in the three (3) months before the event giving rise to the claim.

10. Indemnification

You agree to indemnify and hold harmless CallZI and Rakesh M., and their officers, employees, and agents, from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your misuse of the service or your violation of these Terms or applicable law.

11. Termination

We may suspend or terminate access to the service at any time if you violate these Terms or if we discontinue the service. You may stop using the service at any time. Provisions that by their nature should survive termination (such as disclaimers, limitation of liability, and indemnification) will survive.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Material changes will be communicated as required by law. Your continued use of the service after an update means you accept the revised Terms.

13. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute relating to these Terms or the service will be subject to the exclusive jurisdiction of the courts located in California, unless applicable law requires otherwise.
